By accessing or using gluonDB ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. We may update these Terms from time to time. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

gluonDB is a data analytics platform that enables users to:

• Centralize and manage data from multiple sources
• Upload and store data files (CSV, JSON, Parquet, etc.)
• Connect to external databases and data sources
• Execute SQL queries and analyze data
• Generate visualizations and dashboards
• Utilize AI-powered agents for data science tasks

The Service is provided on a subscription basis with different tiers offering varying levels of functionality, storage, and features.

3. Account Registration and Security

To use certain features of the Service, you must create an account. When you create an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update any information that becomes inaccurate
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You must be at least 16 years old to create an account and use our services.

4. Subscriptions and Payments

4.1 Subscription Plans

5. User Content and Data

You retain ownership of all data, files, queries, and other content you upload or create using the Service ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the Service to you.

5.2 Your Responsibilities

You are responsible for:

• Ensuring you have the right to upload and use your User Content
• Maintaining backups of your important data
• Complying with all applicable laws regarding your data
• Not uploading malicious content or violating third-party rights

5.3 External Data Sources

When connecting external databases or data sources, you are responsible for ensuring you have proper authorization to access and use that data. We are not responsible for any unauthorized access or use of external data sources.

6. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Upload or transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with the proper functioning of the Service
• Use the Service for cryptocurrency mining
• Resell or redistribute the Service without authorization
• Abuse or overload our infrastructure
• Store or process illegal content
• Harass, abuse, or harm others

We reserve the right to suspend or terminate accounts that violate this policy.

7. AI Agent and Automated Features

Our Service includes AI-powered features ("gluon Agent") to assist with data analysis and visualization. When using these features:

• AI outputs are generated based on your inputs and may not always be accurate
• You are responsible for reviewing and validating AI-generated outputs
• AI usage is subject to the limits of your subscription plan
• We may use aggregated, anonymized usage data to improve our AI models

The AI Agent is a tool to assist you, not a replacement for professional judgment. You should independently verify any critical decisions based on AI outputs.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by gluonDB and is protected by international copyright, trademark, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

9. Disclaimers

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• Any errors in the Service will be corrected
• The Service will meet your specific requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GLUONDB, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from unauthorized access or data breaches
• Damages resulting from service interruptions or system failures
• Content or conduct of any third party on the Service

In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless gluonDB and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your User Content after a reasonable period
• Provisions that by their nature should survive will remain in effect

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If resolution cannot be reached, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and gluonDB regarding the Service and supersede all prior agreements, understandings, and communications.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
